What is the Beckham Law?

The Spanish tax regime can be pretty demanding, as regular tax residents have to pay taxes on their worldwide income, which can go up to 52%, and also pay taxes on their worldwide wealth. Quite a lot!

Fortunately, there are several tax benefits available that will help you save money, like the Special Expatriate Tax Regime, known as Beckham Law.

With this regime, you will only be taxed on your Spanish earnings and foreign income from employment. Any other worldwide income won’t be taxed nor will it have to be declared

What are the main advantages of this law?

The Beckham Law, named after the famous football player, David Beckham, who was the first person to benefit from it, provides many advantages:

Allows you to pay property and income taxes as if you were a non-resident during your first 6 residency years.

You will only have to pay a flat tax rate of 24% on your first 600,000 euros income.

You will only have to pay a flat tax rate of 47% for any income above 600,000 euros.

Avoid declaring your goods and assets located abroad and getting taxed on your worldwide income and worldwide wealth.

Avoid getting taxed on foreign capital gains (dividends, sale of shares, interest, etc.).

Please note that you could be subject to a Wealth Tax if your Spanish net worth exceeds the limit of the autonomous community where your highest value of assets is located.

Who can benefit from it?

If you’re an expat living continuously in Spain for more than 183 days, you will be considered a tax resident and therefore be obligated to pay taxes on your earnings.

The Beckham Law can be applied to Spanish tax residents that fall under the following situations:

Foreign individuals with a job offer in Spain that haven’t been tax residents in the last 10 years.

High-income expats that hold executive or management positions.

Managers who have relocated and work in a Spanish company.

The following individuals are excluded:

Self-employed workers or Autónomos.

Professional sports athletes.

Directors of business entities that own more than 25% of equity.

Process with CARBRAY

What are the requirements

To apply for the Special Expatriate Tax Regime, you must first register with the Spanish Social Security as an employee. Once registered, we will have 6 months to submit your application to the Spanish Tax Agency.

We’ll help you to prepare all of the necessary application material for the Special Expatriate Tax Regime:

Complete the 149 Form and file it with the Spanish Tax Agency.

Social Security number.

Passport and NIE number.

An employment contract.

A certificate from your company that states you’re employed with them.

Once your application gets approved, you will benefit from all its tax breaks for up to 6 consecutive years.

  Working with Iris Galván and her team at Carbray to recover my Spanish nationality was the best, and luckiest, decision I could have made.  As a lawyer myself in the USA, I respect the intricacies and technical nuances of the law.  I know the value of expert advice - hiring an experienced lawyer was not a hard decision for me.

What can be easily overlooked, however, is that the decision to acquire a new nationality is also deeply personal, because it touches on identity, family history, a reconciliation of the past with a sense of hope for the future.  Once a process like this is startet, the personal stakes in a successful outcome become enormous. Failure quickly becomes unfathomable.

But, the wheels of bureaucracy turn slowly.  The process is not designed to be easy or efficient. Quite the contrary - it is a three dimensional puzzle with many important pieces hidden from view. To make matters worse, the pieces don't always neatly fit together. The endeavor quickly turns into a waiting game with little or no information flow for long stretches of time.  Second guessing and doubts are inevitable.  Hope can fade. Patience can run short.

I can’t overstate how important it was for me to be reassured by someone I could trust, and who knows what she is talking about, that I should stay the course because things will work out in the end.  I did, and, they did. I am glad I had someone to listen to. And, I am glad I listened.  My Spanish Passport is on the way. And, now it is my daughter's turn.
